Fresh counselling for medical courses stayed

ALLAHABAD: A division bench of the Allahabad High Court on Tuesday stayed the single-judge order whereby the UP government was directed to hold fresh counselling for admissions on the state quota seats of the MD/ MS/MDS/PG diploma course in various state medical colleges and medical/dental faculty of CSM Medical University, Lucknow, on the basis of results declared on March 4.
The order was passed on a special appeal filed by the UP government challenging the single-judge order passed on May 20. The bench, considering arguments of chief standing counsel M C Chaturvedi and the urgency of the matter, stayed the operation of the order of the single judge and added that the matter shall be heard in detail on May 26.
The single judge on May 20 had ordered for fresh counselling to be held without taking into consideration the April 6 circular of the concerned principal secretary regarding negative marking in the UP PG Medical Entrance Exam-2010 for candidates belonging to SC/ST only for determining their eligibility.
The single judge order was passed on a writ petition filed by Hemant Krishna Maurya and others who had appeared in the aforementioned exam for admission to the state quota seats of post graduate MD/MS/MDS courses in various state medical colleges and medical /dental faculty of CSM Medical University , Lucknow.

ALLAHABAD: The petitioners had prayed the court not to permit the candidates belonging to reserved categories who had secured less than 40% marks.The petitioners had sought quashing of the April 6 order of the principal secretary sent to DG, medical education and training, Lucknow, regarding negative marking in UPPGMEE-2010 for the candidates belonging to SC/ST only for the purpose of determining their eligibility.
Incidentally, while the result of the entrance test was declared on March 4 and the counselling was to begin on April 11, the letter was issued on April 6.
It was pleaded in the writ that in accordance with the Post-Graduate Medical Education Regulations, 2000, framed by the Medical Council of India , reserved category candidates have to secure a minimum of 40% marks in the entrance examination to qualify for admission to the post-graduate medical/dental courses. Also, though there is no system of negative marking in the post-graduate medical entrance exam, the UPPGMEE was continuing with negative marking including in this year’s exam. As a result, sufficient number of reserved candidates were not available for filling up all the seats reserved for SC/ST candidates.
Thus, in order to ensure that all the reserved seats are filled up, the letter mentions that the government has taken a decision that for the SC/ST candidates, the marks deducted for wrong answers in the entrance examination shall be added to the marks obtained by them for the purpose of determining their eligibility. However , the merit determined by the university shall not be changed and such candidates who become eligible after adopting the aforesaid procedure shall be permitted to appear at the counseling in accordance with the merit list prepared by the university.
